In compliance with the DMCA, DenverCorner has adopted the following policy for handling copyright infringement claims.
We reserve the right to:
- Remove or block access to material that we believe in good faith to be copyrighted content that has been unlawfully copied or distributed by any of our advertisers, affiliates, content providers, members, or users; and
- Suspend or terminate service to repeat infringers.
Your use of DenverCorner services is always subject to our Terms of Service, which incorporates this Copyright Dispute Policy. Any terms used in this Policy without definition have the meanings given in our Terms of Service.
1. Reporting Copyright Infringement
If you believe that content available on or through our services infringes your copyright (or the copyright of someone you are authorized to represent), please send a written DMCA Notice of Alleged Infringement to our Designated Agent containing all of the following information:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work(s) claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with sufficient detail for us to locate it.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Your name, address, telephone number, and (if available) email address.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
2. Action Upon Receiving a Proper Notice
Once we receive a valid DMCA notice, we may:
- Remove or disable access to the allegedly infringing material;
- Notify the content provider that we have removed or disabled the material; and
- Terminate the accounts of repeat infringers.
3. Filing a Counter-Notice
If you believe that the material removed or disabled is not infringing, or that you have the legal right to post and use such material, you may send a Counter-Notice to our Designated Agent containing the following information:
- A physical or electronic signature of the content provider.
- Identification of the material that has been removed or disabled, and the location where it appeared before removal or disabling.
- A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and (if available) email address.
- A statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located, or if outside the U.S., to any judicial district where DenverCorner is located, and that you will accept service of process from the person who provided the DMCA notice or their agent.
4. Restoration of Material
Upon receiving a valid Counter-Notice, we may send a copy to the original complaining party and inform them that we will restore the removed material or reinstate access within 10–14 business days, unless we receive notice that a legal action has been filed to prevent such restoration.
